Official Sweepstakes Rules

ExxonMobil and General Motors are celebrating 30 years of Corvettes factory filled with Mobil 1 motor oil.  It’s a partnership that offers rewards, like an exclusive 30^th anniversary pin.  ExxonMobil is hosting a sweepstakes to give away 1993 commemorative Corvette x Mobil 1 pins to winners chosen at random, and while supplies last.  This sweepstakes is exclusive to Corvette owners and you must have a verified Corvette VIN to officially enter for your chance to win.

In return for the opportunity to participate in the Chevrolet Corvette 30 Year Factory Fill Celebration Sweepstakes described herein (the “Promotion”), Exxon Mobil Oil Corporation (“EMOC” or “Sponsor”) requires your agreement to comply with and be bound by the terms and conditions set forth below (the “Official Rules” or “Rules”).

• NO PURCHASE OR PAYMENT OF ANY KIND NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
• VOID WHERE TAXED OR PROHIBITED BY LAW.
• ALL DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION AND ENTRANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT.

1. TIMING / WINNER SELECTION DRAWINGS:

The Promotion begins on August 15, 2023 at 8:00 am and ends while supplies last, or at the latest, June 30, 2024 (the “Promotion Period”). During the Promotion Period, there will be regularly scheduled drawings.  Each period of time between drawings is a draw period (“Draw Period”).

2. ELIGIBILITY TO ENTER:

The Promotion is open to residents of the 50 contiguous U.S. / D.C. states who are: (i) U.S. citizens or permanent residents at least 18 years old or the age of majority in their jurisdiction of legal residence, whichever is older as of date of entry; (ii) own a valid Corvette Vehicle Identification Number (VIN) prior to or during the Promotion Period; and (iii) submit the required information associated with the Promotion.  Employees, officers, and directors (including immediate family members (spouse, parent, child, sibling, and their respective spouses, regardless of where they reside) and members of the same household, whether or not related) of the Sponsor, the other Promotion Entities (as defined below) and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers, advertising and promotion agencies, employees or officials of any government, or government-owned or government-controlled entity, that has regulatory authority over EMOC or any of its affiliates and any and all other companies associated with the Promotion are not eligible to participate or win a Prize.

The “Promotion Entities” shall mean organizations directly involved with this Promotion including, Sponsor, Administrator, Theory Communication and Design, participating retailers and each of their respective subsidiaries or affiliated entities, and their officers, employees, and agents.

The Promotion is subject to all applicable federal, state and local laws.  Winning a prize is contingent upon fulfilling all requirements set forth herein.  Sponsor reserves the right, in its sole discretion, to verify the eligibility of winners.  Void in, Puerto Rico, Guam, the U.S. Virgin Islands, all other US Territories and Possessions, and wherever else prohibited by law.

3. AGREEMENT TO BE LEGALLY BOUND BY RULES:

By participating in this Promotion, you are signifying your agreement that you have read and agree to be legally bound by these Rules.

4. HOW TO PARTICIPATE:

NO PURCHASE NECESSARY. MAKING A PURCHASE WILL NOT IN ANY WAY INCREASE OR

OTHERWISE IMPACT YOUR CHANCES OF WINNING A PRIZE.

ONE ENTRY PER VALID VERIFIED CORVETTE VEHICLE IDENTIFICATION NUMBER (VIN).

To enter during the Promotion Period, complete a short survey online and provide all required information. Upon receipt of a valid entry survey, received in accordance with these Rules, participant will be officially entered for a chance to receive one (1) pin. One entry per valid verified Corvette vehicle identification number (VIN).

Website: To enter, visit https://mobil1fromdayone.com/Corvette30th/ (the “Website”) and follow the instructions provided to complete and submit the registration form and survey to receive one (1) entry (each, an “Entry”).  One entry per valid verified Corvette vehicle identification number (VIN).  Entries must be received during the Promotion Period in order to be eligible. Entries generated by script, macro, or other automated means and Entries by any means which subvert the entry process are void.  You may only use one (1) email address to enter the Promotion.  Multiple Entries received from any person or email address in excess of the limit stated above will be void.  All Entries become the sole property of the Sponsor and will not be returned.     

5. ENTRY CONDITIONS:

If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to use multiple names, multiple identities and/or any other means not in keeping with the Sponsor’s interpretation of the letter and spirit of these Rules to enter or otherwise participate in or to disrupt this Promotion; then they may be disqualified from the Promotion in the sole and absolute discretion of the Sponsor.  ExxonMobil Oil Corporation, its parent company and each of their respective subsidiaries, affiliates, agents, employees, directors, successors, and assigns (collectively, the “Released Parties”) are not responsible for, and accept no liability whatsoever in relation to, any late, lost, misdirected, delayed or incomplete information (all of which is void).

6. VERIFICATION:

The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Promotion; (ii) for the purposes of verifying the eligibility and/or legitimacy of any information entered (or purportedly entered) for the purposes of this Promotion; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Promotion in accordance with the Sponsor’s interpretation of letter and spirit of these Rules. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification in the sole and absolute discretion of the Sponsor. 

7. PRIZES:

There will be regularly scheduled prize drawings to award prizes (each a “Prize”) which are available to be won in this Promotion, in each Draw Period.  Subject to Sponsor’s right to substitute a Prize for a different prize of similar approximate retail value in Sponsor’s sole and absolute discretion, the Prizes will be a commemorative Corvette x Mobil 1 motor oil factory fill pin.  The retail value of the commemorative pin is less than one dollar ($1.00).

Prizes are non-transferable with no cash redemption or equivalent.  None of the Released Parties makes any representation or offers any warranty, express or implied, as to the quality or fitness of any Prize awarded in connection with the Promotion.  To the fullest extent permitted by applicable law, each confirmed winner understands, agrees, and acknowledges that they may not seek reimbursement or pursue any legal or equitable remedy from either the Sponsor or any of the other Released Parties should a Prize fail to be fit for its purpose or is in any way unsatisfactory.  

8. RANDOM DRAWINGS – ELIGIBLE WINNER SELECTION PROCESS:

At approximately the end of each Draw Period, winners will be selected (the number to be determined by Sponsor, in its sole discretion) in a random drawing from among all eligible Entries received in accordance with these Rules through the Promotion Period (including, for greater certainty, eligible Entries submitted in a previous Draw Period.  For avoidance of doubt, non-winning eligible Entries from earlier Draw Periods will automatically carry forward to subsequent Draw Periods.  Random drawings will be conducted by Sponsor, or the representative of the Sponsor whose decisions are final on all matters relating to this Promotion.  

The odds of winning depend on the number of eligible Entries submitted and received in accordance with these Rules.  There is a maximum of one (1) Prize per valid verified Corvette vehicle identification number (VIN)regardless of number and/or method of entries.  In the event that no eligible Entry is submitted and received in accordance with these Rules prior to the end of a Draw Period, prizes will roll forward to the next Draw Period, and Prizes will be awarded from among all eligible Entries submitted and received in accordance with these Rules prior to the time of the subsequent draw.  

9. ELIGIBLE WINNER CONFIRMATION PROCESS:

ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR [AND/OR ADMINISTRATOR], WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION.  AN ENTRANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL ENTRANT’S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.

BEFORE AN ELIGIBLE WINNER IS DECLARED AS A CONFIRMED PRIZE WINNER, the eligible winner will be required to be verified by Sponsor, in Sponsor’s the sole and absolute discretion, e.g., administered online, by email, other electronic means, or by telephone.  If an eligible winner: (a) cannot be verified as eligible, in Sponsor’s sole and absolute discretion; (b) cannot accept (or is unwilling to accept) their Prize (as awarded) for any reason; or (c) is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then Sponsor may, in the sole and absolute discretion of the Sponsor, disqualify the participant (and, if disqualified, the participant forfeits all rights to any Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate eligible participant from among the remaining eligible Entries in accordance with the applicable manner set out in Section 8 (in which case the foregoing provisions of this section shall apply to such newly selected eligible winner).

10.  ELIGIBLE WINNER NOTIFICATION PROCESS:

Sponsor’s decisions are final and binding on all matters relating to the Promotion. Potential winners will be notified by e-mail. Potential winners may be required to execute and return an affidavit of eligibility, a liability release and, where lawful, a publicity release within five (5) days of date of issuance. If such documents are not returned within the specified time period, prize notification is returned as undeliverable, Sponsor is unable to contact a potential winner, or a potential winner is not in compliance with these Official Rules, prize will be forfeited and, at Sponsor’s discretion, an alternate winner may be selected for the applicable prize at random from all remaining eligible entries.

11. GENERAL CONDITIONS; LIMITATION OF LIABILITY AND RELEASE; INDEMNIFICATION:

This Sweepstakes is subject to all applicable federal, state, and local laws.  The decisions of the Sponsor with respect to all aspects of this Sweepstakes are final and binding on all entrants without right of appeal.

VOID WHERE PROHIBITED.  NO PURCHASE NECESSARY.

ANYONE DEEMED BY THE SPONSOR TO BE IN VIOLATION OF THE SPONSOR’S INTERPRETATION OF THE LETTER AND/OR SPIRIT OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME. 

By participating, each entrant agrees: (a) to abide and be bound by these Official Rules and decisions of Sponsor, and to waive any right to claim any ambiguity or error therein or in the Promotion itself, which shall be final and binding in all respects relating to this Promotion; (b) to release, discharge and hold harmless the Released Parties from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from entrant’s participation in the Promotion or any Promotion-related activity or the acceptance, possession, use or misuse of the prize, entry, or participation in this Promotion or in any sweepstakes-related activity, or any claims based on publicity rights, defamation or invasion of privacy, or merchandise delivery; (c) to indemnify Released Parties from any and all liability resulting or arising from the Promotion and to hereby acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to Prize, including express warranties provided exclusively by Prize supplier that are sent along with Prize and (d) to the use of his/her name, voice, performance, photograph, caption, entry, and/or likeness for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Sponsor and its designees, without compensation (unless prohibited by law) or additional consents from entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use. By participating, entrant also agrees not to release any publicity or other materials on their own or through someone else regarding their participation in the Promotion without the prior consent of the Sponsor, which it may withhold in its sole discretion.

BY ENTERING THE SWEEPSTAKES, ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (A) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE SWEEPSTAKES, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED ONE DOLLAR ($1.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (C) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED ONE DOLLAR ($1.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (D) ENTRANTS’ REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU. 

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

THE RELEASED PARTIES ARE NOT RESPONSIBLE IF THIS SWEEPSTAKES CANNOT BE ADMINISTERED OR CONDUCTED OR ANY PRIZE CANNOT BE AWARDED DUE TO CANCELLATIONS, DELAYS, OR INTERRUPTIONS RESULTING OR ARISING FROM ACTS OF GOD, WAR, OR TERRORISM, CIVIL UNREST, STRIKES, SUPPLY SHORTAGES, NATURAL DISASTERS, WEATHER, EPIDEMICS, COMPLIANCE WITH ANY LAW OR ORDER OF A GOVERNMENTAL AUTHORITY, OR ANY OTHER SIMILAR ACT, EVENT, OR OCCURRENCE BEYOND THE REASONABLE CONTROL OF THE SPONSOR. BY PARTICIPATING IN THIS SWEEPSTAKES, PARTICIPANT AGREES THAT THE RELEASED PARTIES WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY INJURIES, DAMAGES, OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES TO PERSONS, INCLUDING DEATH, OR TO PROPERTY ARISING OUT OF ACCESS TO AND USE OF ANY WEBSITE ASSOCIATED WITH THIS SWEEPSTAKES OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SUCH SITE, AS APPLICABLE. FURTHER, SPONSOR SHALL NOT BE RESPONSIBLE FOR ANY CANCELLATIONS, DELAYS, DIVERSIONS, CHANGES IN SERVICE OR ACCOMMODATIONS OR SUBSTITUTIONS, OR FOR ANY ACTS OR OMISSIONS BY ANY THIRD PARTIES BEYOND ITS REASONABLE CONTROL, INCLUDING AIR CARRIER(S) AND OTHER TRANSPORTATION COMPANIES; LODGING, RESTAURANT OR OTHER HOSPITALITY PROVIDERS; ENTERTAINMENT PROVIDERS, VENUES OR ARTISTS; OR OTHER THIRD PARTY PROVIDERS SUPPLYING ANY SERVICES OR COMPONENTS OF THE PRIZE(S) TO WINNERS AND/OR THEIR GUESTS, OR FOR ANY RESULTING INJURIES, INCLUDING MONEY DAMAGES, COSTS AND EXPENSES, PROPERTY DAMAGES, PERSONAL INJURIES OR DEATH RESULTING THEREFROM.

The Sponsor reserves the right, in its sole and absolute discretion, to withdraw, amend or suspend this Promotion (or to amend these Rules) in any way, including but not limited to, in the event of any cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Promotion as contemplated by these Rules, including, without limitation, any error, problem, tampering, unauthorized intervention, fraud or failure of any kind whatsoever.  The Sponsor reserves the right, in its sole and absolute discretion, to cancel, amend or suspend this Promotion, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever.

Please see the full Privacy Policy for details.  By participating in the Promotion, participants hereby agree to Sponsor’s collection and usage of your personal information and acknowledge that you have read and accepted Sponsor’s privacy policy. Entrant’s information will be used for purposes of direct marketing, research, and monitoring or improving the use and satisfaction of ExxonMobil’s products.

Released Parties are not responsible for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Promotion, including, without limitation, errors or difficulties which may occur in connection with the administration of the Promotion, the processing of entries, the announcement of any prize, or in any Promotion-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Promotion. Released Parties are not responsible for injury or damage to any person’s computer related to or resulting from participating in this Promotion or downloading materials from or use of the website.

Participant agrees that: (1) any and all disputes and causes of action arising out of or connected with this Promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the participant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction

All federal, state and local taxes and all other costs associated with prize acceptance and use not specified herein as being provided are the sole responsibility of the winners. Prizes will be awarded “as is” with no warranty or guarantee, either express or implied by Sponsor.

In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Promotion-related materials, including, but not limited to, any instructions or interpretations of these Rules given by any representative of the Sponsor, the terms and conditions of these Rules shall prevail, govern, and control to the fullest extent permitted by law.  

The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein.  

To the fullest extent permitted by applicable law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules or the rights and obligations of participants, Sponsor or any of the other the Released Parties in connection with the Promotion will be governed by and construed in accordance with the laws of the State of Texas and the federal laws of the United States applicable therein, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws. The parties hereby consent to exclusive jurisdiction and venue of the courts located in Houston, Texas in any action to enforce (or otherwise relating to) these Rules or relating to this Promotion.

IN THE EVENT THAT YOU DO NOT AGREE TO ANY OF THESE TERMS, YOU MAY NOT PARTICIPATE IN THE PROMOTION.
